VALIDITY AND EXTENSION
USA is the dream destination for those who wish to make their future abroad. L1 visa is work visa to USA for Specialty Knowledge workers without any degree requirements. This is visa is valid initially for a period of 3 years and it can be further renewable for another 3 years. In the exceptional circumstances this visa could be extended for further period of 1 year.
NO LIMIT TO NUMBER
As contract to H1 visa there is no quota limit for L1 visa. Any number of visa can be granted under this category through out the year. Filing of application can be done anytime during the year. While for H1 visa filing can be done only beginning from 1st April every and the no file will be accepted after specified limit of quote is over.
WHO CAN BE ELIGIBLE
L1 A is for the Managerial level jobs and L1B is for other jobs. L1 Visa can be sponsored by a US employer for an existing employee overseas or in the US on another valid visa and valid I-94. In fact its an Intra-Company Transferee visa .A company having office in US and any other part of the world can apply for L1 visa for its employee. A company starting a new branch or subsidiary can also apply for L1 visa.
DEPENDENT VISA TO A FAMILY MEMBERS
L1 visa holders can take their spouse and children below 21 years with them on L2 visa. L2 visa holders can work legally in the US. L1 visa holders cannot take their parents on L2 visas.
TIME FOR GETTING VISA
After filing of a L1 petition, it takes minimum 2 weeks to get a file number. A person can track the status on line with the file number. To process a L1 petition it normally takes 8-10 weeks under normal processing and 2 weeks under premium processing
Its s job visa also there is a dual intent. At the consulate we need not prove family or other ties to convince that we will come back as in case of a B1 or other non-immigrant visas .An L1 holder can upgrade to a green card provided his employer is willing to sponsor him. An L1 visa holder can work only for the company who sponsored his visa. |
